Day 5 of trial of Nicolae Miu for deadly stabbing on Apple River

The trial of Nicolae Miu, the man accused in a deadly stabbing on the Apple River in Wisconsin in July 2022, continued for the fifth day on Friday.

The 54-year-old Prior Lake man is facing homicide, attempted homicide and battery charges stemming from the incident, which killed 17-year-old Isaac Schuman and hurt four others.

Prosecutors say Miu pulled a knife from his pocket and lashed out at a group that was tubing on the river following a confrontation. Miu and his attorneys say he was just looking for his cellphone and the group of teens attacked him, forcing him to defend himself.

Friday, we heard testimony from Miu’s friends he was tubing with on the Apple River that day.

Ernesto Torres was called to testify by the defense — who were allowed to call witnesses even though prosecutors have not wrapped, as Torres spoke through a translator that was in court on Friday.

Torres told the court that Miu “looked worried and he was pale” when he re-joined the group after the confrontation with the teens.

Thursday morning, jurors watched the body-worn camera video of police detaining Miu at the location where tubers exit the Apple River.

Torres was present when Miu was detained by law enforcement.

“We were in shock because we didn’t know why they were detaining him,” Torres testified, adding, “we didn’t know what had happened.”

Another member of Miu’s tubing group, Sergio Ruiz Leyva said he was quiet after re-joining the rest of the group.

“He looked pale when he got close to us,” Leyva stated, adding Miu had his eyes wide open and “he just sat there and didn’t talk anymore.”

A third friend who testified, Ariel Chaguez, said Miu never said a word to him about what happened but recalled hearing an injured young man yell at Miu.

“Nic responded, he defended himself,” Chaguez stated.

Miu’s trial started on Monday, April 1, and is expected to last around two weeks.
