Chauvin attorney asks State Court of Appeals to deny reinstating 3rd-degree murder charge

The attorney for former Minneapolis police officer Derek Chauvin is asking the State Court of Appeals to deny reconsidering a third-degree murder charge.

Chauvin is accused in the fatal arrest of George Floyd last May.

Prosecutors asked Judge Peter Cahill to reinstate the third-degree murder charge against Chauvin, following a recent high court ruling.

Judge Cahill denied that motion to bring back the third-degree murder charge. Then, the state appealed to the State Court of Appeals.

The latest motion by Chauvin’s attorney is asking the State Court of Appeals to deny the state’s request, stating it’s too close to the trial in March and untimely.
