Attorney of Thomas Lane to seek dismissal of charges in Floyd death case

The attorney for Thomas Lane, one of the four former Minneapolis police officers charged in the death of George Floyd, will seek to have the charges against his client dismissed.

Earl Gray, Lane’s counsel, argues in a memorandum filed with the motion to dismiss that "there is no probable cause for charges."

As part of his court filing, attorney Earl Gray filed transcripts from body camera footage recorded by Lane’s camera and the camera of his partner, J. Kueng. Gray also filed a transcript of Lane’s interview with state investigators.

Lane has been charged with aiding and abetting second-degree murder and aiding and abetting second-degree manslaughter. Kueng and Tou Thao face the same charges. All three have been released from jail on bond.

Former officer Derek Chauvin, who was seen in video with his knee on Floyd’s neck, has been charged with unintentional second-degree murder, third-degree murder, and second-degree manslaughter.

Court records say the State of Minnesota has until Aug. 10 to file a response. If Lane and his attorney believe a reply is necessary, a response must be submitted by Aug. 17.
