The Hennepin County Attorney’s Office confirmed that it has deferred the case for additional investigation.

Thirty-year-old Martin Johnson was killed in the shooting.

The homeowner told police that Johnson had broken into her garage and said she fired four warning shots to get him to leave, an affidavit states. She told police she shot Johnson when he started walking toward her and her son.

Johnson’s family held a press conference Tuesday, calling for police to release more information in the case and demanding charges against the homeowner.
