Arguments will be made Monday in front of the United States Supreme Court regarding a lease dispute involving the Mall of America.
Sears, which was an original anchor tenant of the mall, signed a 100-year lease in 1991 for just $10 per year.
However, for three years, the mall has tried to undo that sale to Transform Holdco, the company formed by Sears’ new owners.
Arguments will focus on whether the mall can appeal the bankruptcy court order that approved the lease sale.
The mall believes Transform Holdco will take advantage of the lease by subleasing the space.
