State settles lawsuit against Wabasha County gym over violated executive orders

Monday, Minnesota Attorney General Keith Ellison announced the state has settled its lawsuit against a Wabasha County gym over violations of Gov. Tim Walz’s executive orders.

The agreement states Plainview Wellness Center will pay a $5,000 fine and comply with all current and future executive orders.

If Plainview Wellness Center violates the agreement, it would be subject to a civil penalty of $25,000, Ellison’s office said.

Plainview Wellness Center remained open despite executive orders and legal measures taken against it that ordered it to close for public health measures related to reducing the spread of COVID-19.

"It’s every Minnesotan’s responsibility to stop the spread of COVID-19. I thank this business for agreeing to meet its responsibility and rejoin the vast majority of Minnesota businesses that are already doing so," Ellison said. "The situation is improving but we’re not out of the woods yet, so we must all keep following the COVID guidance and restrictions. My top priority has always been educating Minnesotans about their responsibility and winning voluntary compliance. Enforcement has been and will continue to be a last resort."

According to Ellison’s office, this is the fourth settlement reached with businesses that violated Walz’s executive orders.
