Prosecutor declines to charge officers who fatally shot Brooklyn Center man

Wednesday, Hennepin County Attorney Mike Freeman announced that use of force by two officers Brooklyn Center police officers in the shooting death of Kobe Dimock-Heisler was justified and declined to file charges.

According to authorities, on Aug. 31, 2019, Brooklyn Center officers Cody Turner and Brandon Akers shot and killed Dimock-Heisler while responding to a call about a domestic situation involving a knife.

The attorney’s office says police were called after Dimock-Heisler threatened his grandfather with a knife and hammer.

When officers arrived, they patted down Dimock-Heisler and found he had no weapons. The officers then sat him down in a chair.

Authorities say at one point during the call, Dimock-Heisler sprang up and started running toward his grandmother. While police tried to stop Dimock-Heisler, officers Turner, Akers and Stephen Holt deployed their Tasers.

According to Freeman’s office, Dimock-Heisler reached into a couch, pulling out a knife. He then tried to stab one of the officers in the lower legs. Authorities say at that point, Turner and Akers fired their guns, hitting Dimock-Heisler.

The officers had their body cameras on, and the footage was reviewed by investigators and prosecutors.

Freeman concluded the officers acted within Minnesota law.

"Both officers saw Mr. Dimock-Heisler attempting to stab Officer Vu with a knife," according to the attorney’s office report. "Officers Turner, Akers and Holt attempted to subdue Mr. Dimock-Heisler with tasers to no avail. With all less lethal options exhausted, officers Turner and Akers were justified in resorting to deadly force."
