UPDATE: Man charged with two variants of vehicular homicide in connection with North Branch crash

A criminal complaint filed in Chisago County District Court on Monday lists charges for a man in connection with a fatal crash Friday on Interstate 35 in North Branch.

Samuel Moreno, 23, was charged with two variants of vehicular homicide — operating a vehicle with negligence under the influence of alcohol and leaving the scene of a collision — as well as driving while under the influence of alcohol and driving with a revoked license, according to the court document.

The criminal complaint states that Chisago County Sheriff's deputy found a black Toyota Tundra, the suspected striking vehicle, at the Goose Creek Rest Area north of the crash. The deputy noticed a footprint on the sidewalk outside the driver's door of the truck and found Moreno lying on the floor of the rest stop bathroom.

Moreno "appeared very impaired" upon discovery, the complaint states. A state trooper on the scene noted that Moreno carried a moderate odor of alcohol and a strong odor of marijuana. He was unable to answer basic questions.

When the deputy and the trooper attempted to put Moreno under arrest, he resisted, and the deputy had to Taser him multiple times to get him under control, according to the complaint. Officers found a bag of suspected marijuana, four marijuana pipes and a small plastic bag containing an unknown substance in Moreno's pockets.

A sample of Moreno's blood was taken for testing and will be sent to the Minnesota Bureau of Criminal Apprehension.

A driver involved in a fatal crash Friday was unlicensed at the time of the crash, according to criminal records.

Samuel Moreno has been identified as the driver of the Toyota Tundra that rear-ended a Buick Park Avenue. 

The driver of the Buick did not survive the crash. 

According to court records, Moreno has multiple instances of driving without a license, driving without insurance and speeding.

The Minnesota State Patrol responded to a fatal crash on Friday in North Branch. 

According to the crash report, a Toyota Tundra was speeding on northbound Interstate 35 at mile maker 149 when it rear-ended a Buick Park Avenue driven by 63-year-old Joffre Michael Kolosky. 

The rear end collision caused Kolosky's vehicle to go off-road and roll.

The Toyota left the scene of the accident, but it was located shortly after. That driver has been identified as 23-year-old Samuel Dakota Moreno of Mankato. He was not injured in the crash.

Officials say alcohol is believed to be a factor in this incident.
