A former St. Paul City Council candidate was sentenced Friday for posting a nude photo of a woman online without her consent.
Court documents say David Martinez, 39, was sentenced to two years of supervised probation. He was also sentenced to one year at the Ramsey County Correctional Facility, but was given credit for 12 days served, and the rest of his sentence was stayed and will likely be waived as long as he follows the conditions of his probation.
Martinez was charged in December with nonconsensual dissemination of private sexual images in Ramsey County.
The criminal complaint stated that on July 14 of last year, the woman reported Martinez had posted a nude photo of her on his Wordpress.com web page. The post allegedly appeared on the web page "David Martinez for City Council, Ward 4" under a post entitled "Transparency."
The complaint said Martinez denied posting the image and said his accounts were hacked and that "someone was trying to sabotage his campaign." He later allegedly told police he had given away his laptop to three kids he saw on the street, but that the woman had deleted all documents and photos on it.
However, when he was booked into the Ramsey County jail for violating an order for protection on Aug. 8, an Apple MacBook Pro was in his backpack. He allegedly claimed at that time that he had gotten it back from the kid he gave it to.
A search revealed the "several hundred thousand images," including the same photo of the woman posted on his WordPress web page.
