Passengers stranded in Mexico after Sun Country cancellations suing airline

Two passengers stranded in Mexico after Sun Country canceled flights because of winter weather in Minnesota last April are suing the airline in federal court alleging breach of contract and negligence.


Wayne Thomas LaBeau and Ma Florentina Busso LaBeau originally filed the lawsuit in Dakota County, but this week filed to move the lawsuit to U.S. District Court.

In an email to affected passengers in April, Sun Country explained "because this cancellation is due to weather, and our seasonal service has ended, you will need to make arrangements on another airline for your return flight." 

The president and CEO of Sun Country acknowledged in an email to the airline's employees that the company should have flown a rescue flight to Mexico to retrieve customers who struggled to get home.

In a statement, Sun Country said it could not comment on the current lawsuit. But stressed it tried to accommodate all passengers affected by the winter weather.

"During the extraordinary weather event in April 2018, Sun Country went above and beyond to accommodate all of our passengers affected by the incident across dozens of flights," the statement read.

"In regards to the specifics of pending litigation, we can not comment."
