Gov. Mark Dayton expressed "concern" over a Department of Human Services (DHS) investigation that questions a backroom deal by a top DHS official.

5 EYEWITNESS NEWS first reported DHS completed an internal investigation that questioned a deal Assistant DHS Commissioner Scott Leitz, made with Fairview's Amplatz Children's Hospital.

The investigations says, in part, Leitz made a deal with Fairview to help the hospital get Medicaid money it might not have been qualified to receive. A DHS employee blew the whistle on the agreement and that's why the investigation was conducted.

Investigative notes say the deal would have brought Amplatz $38.5 million over a four year period.

Dayton reacted to the 5 EYEWITNESS NEWS story saying he is "concerned" and that he has confidence DHS Commissioner Lucinda Jesson, Leitz's boss, "will get to the bottom of it and take appropriate action, if necessary."

After our story aired, one state lawmaker questioned Leitz's ethics and called for his resignation or removal from his job.

State Representative Sarah Anderson, (R) Plymouth, says, "Leitz's actions erode public confidence because it appears he was using taxpayers' money to take care of buddies in the hospital system." Rep. Anderson went on to say "he should help restore public confidence in the system and resign immediately."

Rep. Anderson is a member of the influential House Ways and Means Committee.

DHS officials tell us they are seeking a legal opinion and will not take any action until they receive that opinion.
