The family of a Pakistani student who faced possible deportation while receiving medical care after an accident is now suing a northern Minnesota hospital and doctor.

In a lawsuit filed Friday, the brother of Muhammed Shahzaib Bajwa claims a doctor at Cloquet Community Memorial Hospital didn't quickly ensure that Bajwa's airway was unobstructed. As a result, the lawsuit says, Bajwa suffered permanent brain damage.

A message left with the hospital chief executive wasn't immediately returned.

Bajwa was injured Nov. 13 when the car he was in struck a deer. The University of Wisconsin-Superior student is now in long-term medical care.

While hospitalized, Bajwa's student visa was set to expire. Authorities worked to get him a visa that allowed him to stay in Minnesota.

The lawsuit seeks damages for medical care.
