Group Files Lawsuit to Shut Down Illegal 'Safe Driving' Course

A group of citizens has filed a lawsuit after finding out that a safe driving class they took was illegal.

The safe driving class is offered to drivers as a cheaper alternative to getting a ticket on their record. But back in January, a Wabasha County judge ruled that offering the courses is illegal because all of the money goes to the counties or cities, so the state doesn’t get a portion of the revenue.

Now, the group of citizens is suing to get their money back; they believe they are owed more than $2 million as a whole.

"If you get money illegally, you've got to give it back," Erick Kaardal, the attorney representing the group, said.

The lawsuit claims there are 12 counties and cities still offering the class: Chippewa, Sibley, Chisago, Meeker and Wright Counties, and the cities of Circle Pines, Buffalo, Clara City, Lexington, Coon Rapids, Centerville and Lino Lakes. The 89-page lawsuit also asks to shut down these current programs.

There is talk in the Senate to change the law to make the safe driving courses legal; the suggested class would stay at $75 per person, and the money would then legally go entirely to the cities and counties offering the courses.
