Safe Driving Programs provide a cheaper alternative for drivers caught committing minor traffic offenses. Rather than pay a more expensive traffic fine, the programs allow drivers to take a class and keep the offense from their insurance companies.

Two weeks ago, a judge ruled the program in Wabasha County was illegal after a group of citizens filed suit to stop the program.

Now that same group is considering whether to file a class action lawsuit on behalf of drivers who have participated in the safe driving courses. Attorneys considering such an action say drivers may be entitled to refunds.

If successful, cities and counties would be impacted should they be required to reimburse drivers.

It's not clear though, attorneys say, whether those interested in a class action suit might have access to the names and addresses of everyone who participated in the classes.

Since the suit in Wabasha County was filed, 5 EYEWITNESS NEWS has been told 19 cities and counties have voluntarily suspended their safe driving programs.
