Minnesota Attorney General Lori Swanson's office recently told 5 EYEWITNESS News she lacked the authority to enforce a state law more than a dozen county sheriffs are accused of breaking.

However, a legal analysis that examined case law dating back 100 years found Swanson does have the authority to stop county sheriffs from running their own traffic diversion programs.

These programs, cheaper classroom alternatives to paying a traffic fine, allow the counties to keep all of the money they receive from the classes without giving the state a cut as they would when someone pays a traffic fine.

A Republican state lawmaker is now calling on Swanson to enforce the law or step down.
