A former Eagan day care provider was sentenced to 15 years of probation and 90 days in jail Thursday.
In July, 33-year-old Mariel Alexandra Grimm was convicted of first-degree assault after a 13-month-old boy in her care was found with serious injuries a year ago.
The sentence was a significant downward departure, as Grimm was originally faced with at least seven years in jail.
Grimm's attorney said she has already filed an appeal.
According a criminal complaint, Grimm told investigators the boy became unresponsive while she was changing his diaper after he had woken up from a nap crying. She said the boy remained unconscious while she tried to splash water on his face to revive him. She said she then called the boy's mother, who told her to call 911.
A child pediatrician's examination later revealed the boy suffered a subdural hemorrhage, which is associated with a violent acceleration-deceleration event, such as a high-speed car crash or shaking or throwing a baby. The neurosurgeon who performed emergency surgery said the boy could have become unresponsive either immediately or shortly after sustaining that kind of head trauma.
The boy survived but suffered serious and permanent brain damage.
