Essentia Health has confirmed it laid off 50 employees who did not receive a flu vaccine.

The Duluth-based health system made getting the flu shot a job requirement. However, the union representing some industrial and service workers at Essentia Health filed for an injunction in U.S. District Court.

A judge, however, upheld the policy.

A spokesperson for the company confirmed Tuesday that 50 people who did not receive the vaccine were laid off.

"More than 99.5 percent of Essentia's 13,900 colleagues have made a commitment to the safety of their patients and community by receiving the flu vaccine, being approved for an exemption, or are in the exemption process," the statement from Essentia media relations specialist Maureen Talarico said.

"(The) calculation below is accurate of those who did not choose to adhere to the policy.
