JUDGE: Petters' statements, evidence allowed in trial
 

A judge has ruled statements made by indicted businessman Tom Petters will be allowed in court along with evidence seized from his home.

While the Twin Cities business giant pleaded not guilty to running a multi-billion dollar Ponzi scheme, the FBI testified last month that Petters told them ‘I'm the guy in charge and I’ll bite the bullet if I need to.’

In March, Petters attorneys wanted the statement thrown out, arguing the FBI violated his constitutional rights.

At that time, a judge heard testimony from federal agents in Las Vegas, Nev. who interviewed Petters in his suite at the Bellagio Hotel on the same September day that federal agencies raided Petters Worldwide headquarters in Minnetonka.

"We don't have any merchandise in these warehouses. It doesn't exist," Petters said, according to the Nevada investigators.

While prosecutors called it a 'confession,' the defense says the statements were obtained improperly, as Petters wasn't given a Miranda warning.

But on Tuesday, Magistrate Judge Arthur Boylan disagreed and ruled that most of the evidence seized at Petters home and business can also be used at trial.

Petters’ jury trial is set to begin Sept. 14 with jury selection beginning Sept. 8.
