Judge: Amy Senser Must Stay in Prison During Appeal

The judge in the Amy Senser case says Senser must stay in prison while she appeals her case.

Senser's attorneys argued earlier this week that she should be free while her appeal went forward.

Senser's motion was denied.

Judge Daniel H. Mabley ruled Wednesday that Senser's attorneys hadn't presented enough evidence that her appeal was likely to succeed. Mabley also took issue with Senser's defense, writing that she and her attorneys had sought to influence the case through the media since it began.

In the Order Denying Defendant's Realease on Appeal, Mabley wrote the appeal is not likely to succeed and is both frivolous and used for purposes of delay.

Senser's lawyer Eric Nelson released a statement saying, "The defense is not surprised by the court's decision. We will vigorously respond in our filings with the Court of Appeals."

The wife of former Vikings player Joe Senser was convicted in May of criminal vehicular homicide for killing Anousone Phanthavong with her SUV in August 2011.
